📸 Ishanika_Photos_ Photography & Videography Policy 1. Booking & Retainer • A non-refundable retainer is required to secure all sessions, events, and dates. • Bookings are confirmed only after the retainer is received. • Remaining balances must be paid before or on the day of the session unless otherwise agreed in writing. 2. Payments • Accepted payment methods include: Credit Card, PayPal (IshanikaPhotos), Navy Federal Access #23744619, Cash App $IshanikaPhotos, and in-person Card Reader. • Payments not received by the due date may result in cancellation without refund of the retainer. 3. Cancellations & Rescheduling • Retainers are non-refundable. • Clients may reschedule once with at least 48 hours’ notice. • Requests within 48 hours, same-day cancellations, or no-shows forfeit all payments and require a new retainer. • Standard cancellation fee: $85. 4. Late Arrival Policy • Sessions start at the scheduled time. • Late arrivals may reduce session coverage. • Arrivals more than 20 minutes late may be canceled at the photographer’s discretion. 5. Session Coverage & Cooperation • Every effort is made to capture requested shots. • Specific images cannot be guaranteed due to timing, lighting, subject cooperation, weather, or venue restrictions. 6. Image & Video Editing • All delivered work is professionally edited in the photographer’s style. • Extensive retouching may incur additional fees. 7. RAW & Unedited Files • RAW images, unedited photos, and unedited video footage are never released. 8. Delivery Timeline • Final edited galleries are delivered digitally within 2 weeks depending on session type, workload, and season. 9. Image Selection • Clients select final images within package limits. • Additional edited images are available for purchase. 10. Copyright & Usage Rights • All content remains the photographer’s property. • Clients receive personal-use rights only. • No downloading, redistribution, alteration, sale, or commercial use is allowed without written permission. 11. Model Release • Booking grants permission for images/videos to be used for portfolio, website, social media, marketing, and advertising unless a written opt-out is submitted. 12. Weather & Uncontrollable Conditions • Outdoor sessions may be rescheduled due to unsafe weather or uncontrollable circumstances. • Photographer determines if conditions are unsafe. 13. Client Responsibility • Clients must arrive prepared and on time. • Photographer is not responsible for missed shots due to lateness, lack of preparation, or uncooperative subjects. 14. Health & Safety • Clients who are sick or showing symptoms of contagious illness (COVID-19, flu, etc.) must stay home. • Sessions may be rescheduled at the photographer’s discretion with at least 48 hours’ notice. 15. Overtime & Additional Services • Sessions exceeding booked time or including extra services incur additional fees, payable before or at the session. 16. Travel Fees • Travel outside the standard service area may incur additional fees of $25, disclosed at booking. 17. Minors Policy • Clients under 18 must have a parent or legal guardian present. • Parent/guardian is responsible for booking, payment, and signing releases. • Photographer is not responsible for unsupervised minors. 18. Emergency Cancellation by Photographer • In rare cases (illness, accident, equipment failure), clients will be offered a reschedule or refund of payments received. 19. Special Equipment or Drone Use • Drone or specialized equipment use follows all safety regulations. • Clients must cooperate to ensure safety. 20. High-Demand Periods • Rescheduling during holidays, prom, graduation, or other high-demand periods is limited and subject to availability. 21. Liability • Photographer is not responsible for injuries, damages, lost items, or accidents. • Liability is limited to a refund of payments received in rare cases of equipment failure, illness, or emergency. 22. Sales Tax & Gratuity Service Tax • Photography and videography services may be subject to applicable service sales tax based on state and local regulations. • For Houston, TX clients, this is typically 8.25%. • GlossGenius automatically calculates service tax at checkout. Retail Sales Tax • Physical products sold (prints, albums, canvases, framed photos, etc.) are subject to retail sales tax (Houston, TX = 8.25%). • GlossGenius automatically calculates retail tax at checkout. No Tax on Gratuity • Optional tips or gratuities are not subject to sales tax. Responsibility for Taxes • Clients agree that all applicable taxes are included in the total amount due at checkout. • Taxes collected are remitted by Ishanika_Photos_ according to state and local law. Payment Requirement • All session fees, product fees, and applicable taxes must be paid in full before or on the day of the session. • All payments are non-refundable. 23. Agreement • Booking a session confirms that clients have read, understood, and agreed to all policies above, including taxes and travel fees.
